Terms of Service

1. Who we are

The Service is operated by Roman Duda, a sole trader (OSVČ) registered in the Czech Republic, IČO 29808154, with a place of business at Zelenečská 519/44, 198 00 Praha 9 – Hloubětín, Czech Republic. Registered in the Czech Trade Licensing Register (živnostenský rejstřík); competent trade licensing office under § 71(2) of the Trade Licensing Act: Podnikající osoba zahraniční. In these Terms, “we,” “us,” and “our” refer to Roman Duda, trading as Caliente Signals.

2. What the Service is

Caliente Signals is a web-based notification tool. You define your own technical-analysis rules on supported crypto assets, and the Service notifies you when public market data matches those rules.

The Service does not execute trades on your behalf, does not connect to your exchange accounts, does not hold or custody your funds, and does not provide investment, financial, legal, or tax advice or recommendations.

3. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you confirm that you are 18 or older and have the legal capacity to enter into these Terms.

4. Your account

You are responsible for the credentials used to access your account and for activity that occurs under it. Notify us promptly if you believe your account has been used without your authorization.

5. Subscription and payment

The Service offers a free tier and a paid tier. Subscription fees are as displayed during checkout. We are not registered for VAT, so no VAT is added to the price you see.

We may change subscription fees from time to time. Existing subscribers will be notified before any such change takes effect and may cancel their subscription before that date.

6. Cancellation and withdrawal

You may cancel your paid subscription at any time from Settings. Cancellation takes effect at the end of the current billing period; access to paid features continues until then.

Separately, if you are a consumer in the European Union you have the right to withdraw from the contract within 14 days of subscribing, without giving a reason. To exercise it, tell us at hello@calientesignals.com in any clear statement, or use the model form in section 16. We will refund what you have paid, reduced in proportion to the part of the billing period already provided to you, within 14 days of being informed.

7. Acceptable use

You agree not to: use the Service for fraudulent or unlawful purposes; attempt to gain unauthorized access to the Service, other users’ accounts, or our infrastructure; reverse-engineer or scrape the Service or its underlying data; resell or redistribute notifications generated for your account; or interfere with the operation of the Service.

9. No warranty of accuracy or availability

The Service depends on third-party market data and communication channels (including but not limited to Telegram and email delivery providers). We do not warrant that market data will be accurate, complete, or timely, that notifications will be delivered without error or delay, or that the Service will be available without interruption.

10. Intellectual property

We retain all rights in the Service, including its brand, user interface, and underlying software. The strategies and configurations you create remain yours; you grant us a limited license to process them solely as necessary to provide the Service to you.

11. Termination

You may stop using the Service at any time and delete your account from Settings. We may suspend or terminate access if you materially breach these Terms or if continued provision of the Service to you would expose us to legal or operational risk. Sections covering disclaimers, limitation of liability, and governing law survive termination.

12. Limitation of liability

To the maximum extent permitted by applicable law, the Service is provided “as is” and “as available,” without warranties of any kind. Our aggregate liability arising out of or relating to your use of the Service is limited to the total fees you paid to us in the twelve (12) months immediately preceding the event giving rise to the claim.

Nothing in these Terms limits our liability for fraud, willful misconduct, gross negligence, or any other liability that cannot be limited or excluded under applicable law. Mandatory statutory rights of consumers in the European Union are not affected by this clause.

13. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated by email or by in-app notice before they take effect. Continued use of the Service after the effective date of the updated Terms constitutes acceptance.

14. Governing law and disputes

These Terms are governed by the laws of the Czech Republic, without regard to its conflict-of-laws principles. Disputes shall be submitted to the competent courts of the Czech Republic, except that consumers resident in the European Union retain the right to bring disputes before the courts of their place of residence and to rely on any mandatory consumer- protection rules of their place of residence.

If we cannot resolve a complaint between us, consumers may bring the dispute to the competent out-of-court dispute resolution body, the Czech Trade Inspection Authority (Česká obchodní inspekce): coi.gov.cz. Using it is free for you and does not affect your right to go to court.
